CODE OF CONDUCT

Applies to: All employees, contractors, casual staff, managers, and directors

1. Purpose
BAKAEVE PTY LTD (“the Company”) is committed to providing a workplace that is safe,
respectful, and free from bullying, harassment, and sexual harassment.
This Code of Conduct sets out:
• The standards of behaviour expected of all workers
• The Company’s commitment to preventing inappropriate workplace behaviour
• Compliance with the Occupational Health and Safety Act 2004 and related
regulations

2. Scope
This Code of Conduct applies to all work-related situations, including but not limited to:
• During working hours
• At all Company workplaces and facilities
• During work-related events, training sessions, meetings, or social functions
• Interactions with colleagues, clients, contractors, and visitors
• All work-related communication, including phone, email, messaging apps, and
social media

3. Expected Standards of Behaviour
All workers must:
• Treat others with dignity, respect, and professionalism

• Maintain appropriate professional boundaries at all times
• Behave in a manner that does not cause harm, offence, intimidation, or
humiliation
• Comply with all Company policies and lawful directions

4. Sexual Harassment and Inappropriate Behaviour
4.1 Definition of Sexual Harassment
Sexual harassment is any unwelcome conduct of a sexual nature that a reasonable
person would expect to offend, humiliate, or intimidate another person.
Examples include, but are not limited to:
• Unwelcome sexual comments, jokes, or remarks
• Inappropriate staring, gestures, or sexual advances
• Sending or displaying sexually explicit messages or images
• Unwanted physical contact
• Requests for sexual favours

4.2 Prohibited Conduct
The following behaviours are strictly prohibited:
• Sexual harassment, bullying, or intimidation
• Abuse of authority or position for personal or sexual advantage
• Unwanted personal attention or pressure outside of work duties
• Retaliation against any person who makes or participates in a complaint
• Encouraging, ignoring, or covering up inappropriate behaviour

5. Reporting Concerns
Employees are encouraged to report any concerns or incidents of inappropriate
behaviour as soon as possible.

Reports may be made to:
• A direct manager or supervisor
• Another manager or director
• In accordance with the Company’s Incident and Complaint Reporting Procedure
All reports will be treated confidentially, where practicable, and retaliation against a
person who raises a concern in good faith will not be tolerated.

6. Investigation and Company Response
• All complaints will be taken seriously and handled in a fair, timely, and impartial
manner
• Investigations will follow principles of procedural fairness
• Outcomes will be communicated to relevant parties where appropriate
• Appropriate corrective actions will be implemented

7. Responsibilities
Employees
• Understand and comply with this Code of Conduct
• Participate in required training
• Report inappropriate behaviour or safety concerns
Managers and Directors
• Lead by example and model appropriate behaviour
• Ensure workers are aware of this Code of Conduct
• Act promptly on reports or concerns
• Do not ignore, minimise, or conceal inappropriate behaviour

8. Breach of Code and Disciplinary Action

A breach of this Code of Conduct may result in disciplinary action, including:
• Formal warnings
• Mandatory training
• Changes to duties or work location
• Suspension
• Termination of employment (including summary dismissal)
Disciplinary action will be proportionate to the seriousness of the breach.

9. Acknowledgement
All workers are required to acknowledge that they have read, understood, and agree to
comply with this Code of Conduct.
Signed acknowledgement forms will be retained on the employee’s personnel file.
