101 FITNESS TERMS OF SERVICE
Welcome to 101fitness. If you continue to use our service, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern 101fitness relationship with you in relation to this service. If you disagree with any part of these terms and conditions, please do not use our service.
1. MEMBERSHIP AGREEMENT: 1.1. By joining the gym, you acknowledge that you are at least 18 years old or have obtained consent from a legal guardian if you are under 18. 1.2. Membership is personal and non-transferable. You may not assign or transfer your membership to anyone else.
2. GYM ACCESS AND HOURS: 2.1. Members are granted access to the gym during the operating hours specified by the management. 2.2. The gym reserves the right to modify the operating hours or close the facilities for maintenance, repairs, or holidays. Notice will be provided to members whenever possible.
3. CODE OF CONDUCT: 3.1. Members must conduct themselves in a respectful and responsible manner while using the gym facilities. 3.2. Harassment, discrimination, or any form of inappropriate behavior towards other members or staff will not be tolerated and may result in immediate termination of membership. 3.3. Members are expected to follow the rules and instructions provided by the gym staff regarding equipment usage, safety guidelines, and cleanliness. (Non-compliance may lead to $50 fine). 3.4 Members must wear appropriate closed-toe athletic shoes at all times while using the gym facilities. Bare feet, socks only, slippers, slides, crocs, sandals, or any open-toe shoes are not permitted. The gym reserves the right to refuse entry or ask members to leave if this policy is not followed. 3.5 Members must not drop, slam, or throw weights unnecessarily. All weights and equipment must be handled in a safe and controlled manner at all times. 3.5. Unauthorized entry or helping it (Using gym without membership, Letting Non-member in, etc.) will incur $250 fine per offence.
4. HEALTH AND SAFETY: 4.1. Members are responsible for ensuring that they are in good health and capable of engaging in physical exercise. It is advised to consult with a healthcare professional before starting any new fitness program. 4.2. Members are required to use gym equipment and facilities safely, following proper techniques and guidelines. Any damage caused by negligence or misuse may result in liability for repair or replacement costs.
5. MEMBERSHIP FEES AND PAYMENTS: 5.1. Membership fees are determined by the gym and are subject to change. Notice of any fee changes will be provided in advance. 5.2. Membership fees are payable on a regular basis as per the agreed-upon schedule, such as weekly or fortnightly. 5.3. Failure to pay membership fees within the specified timeframe may result in suspension or termination of membership. 5.4 If membership payments are overdue, a $3 fine will be charged per time in addition to the outstanding payment. 5.5 Whenever you pause the membership, processing fee of $10 (per month) will be charged.
6. CANCELLATION AND REFUNDS: 6.1. Members can cancel their membership by providing written notice to the gym. Any applicable cancellation fees or refund policies will be outlined in the membership agreement. 6.2. Refunds may be provided on a case-by-case basis at the discretion of the gym management. 6.3. 4-week cancellation period applies to terminating your membership. Within this time, you may receive a final bill. You are welcome to continue to use the gym until your 4-week cancellation period expires.
7. PERSONAL BELONGINGS: 7.1. The gym is not responsible for the loss, theft, or damage of personal belongings brought onto the premises. 7.2. Members are encouraged to use lockers or other secure storage options provided by the gym to safeguard their belongings.
8. AMENDMENTS AND MODIFICATIONS: 8.1. The gym reserves the right to modify or amend these Terms and Conditions at any time. Notice of any changes will be communicated to members in advance.
9. GOVERNING LAW AND JURISDICTION: 9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
By becoming a member, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions. Failure to comply with these terms may result in the termination of your membership.
UPFRONT GYM MEMEBERSHIP
This Gym Membership Agreement (the "Agreement") is entered into between 101 Fitness, hereinafter referred to as the "Gym," and the undersigned member, hereinafter referred to as the "Member." By signing this Agreement, the Member agrees to abide by the terms and conditions outlined herein.
1. MEMBERSHIP FEES: 1.1. The Member agrees to pay the applicable membership fees as outlined in the Membership Agreement. 1.2. Membership fees are non-refundable and non-transferable, regardless of usage or circumstances.
2. MEMBERSHIP DURATION: 2.1. Membership begins on the effective date of this Agreement and continues for the duration specified in the Membership Agreement. 2.2. Early termination of the membership by the Member does not entitle the Member to a refund of any fees paid.
3. USAGE OF FACILITIES: 3.1. The Member agrees to use the gym facilities in a responsible and safe manner. 3.2. Any damage to gym equipment or facilities caused by the Member's negligence may result in additional charges.
4. CODE OF CONDUCT: 4.1. The Member agrees to adhere to the Gym's Code of Conduct, as posted within the facility. 4.2. Failure to comply with the Code of Conduct may result in the termination of the membership without refund.
5. TERMINATION: 6.1. The Gym reserves the right to terminate the membership of any Member violating the terms of this Agreement or the Code of Conduct. 6.2. Termination does not entitle the Member to a refund of any fees paid.
6. NO REFUND POLICY: 7.1. Upfront gym membership fees are non-refundable. 7.2. The Member acknowledges and agrees that no refunds will be provided for any reason, including but not limited to relocation, illness, or dissatisfaction with services.
7. AMENDMENTS: 8.1. The Gym reserves the right to amend the terms and conditions of this Agreement with notice to the Member. 8.2. Continued use of the gym facilities after the effective date of amendments constitutes acceptance of the updated terms.
By signing below, the Member acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Gym Membership Agreement.
PRIVATE TRAINING LESSON MEMEBERSHIP
The use of our training service is subject to the following terms of use:

A single casual session or any casual session packages should be paid all on that day.

20 package casual sessions will be expired within 6 months period time and 10 package within 3 months.

If there are casual sessions left over and want to transfer to others. It can be transferred to others, but expired date is still same.

All (challenge) programs should be paid 2weeks fee in advance and rest will be paid every 2 weeks.

Casual sessions can be hold for specific reasons [including injury, holiday, etc.].

Cancellation due to personal reasons should be told 1 day prior to each session, and if cancelation happens twice for personal reasons the session may expire.

All programs should be ended as per the contract.
REFUND & CANCELLATION POLICY
101 fitness is committed to 100% customer satisfaction. You can claim your unused sessions to refund anytime, but under Refund policy.

A cancellation fee 10% of refund will be applied.

Gym membership will take 4 weeks of termination period.

Free sessions will not be included.

You will be able to get 100% full refund for the specific reasons (including death or other exceptional circumstances, natural disaster, etc.).

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.
